{"id":1426,"date":"2023-11-13T13:08:49","date_gmt":"2023-11-13T13:08:49","guid":{"rendered":"https:\/\/punjabcsr.com\/?page_id=1426"},"modified":"2024-02-18T07:48:10","modified_gmt":"2024-02-18T07:48:10","slug":"pay-fixation","status":"publish","type":"page","link":"https:\/\/punjabcsr.com\/index.php\/pay-fixation\/","title":{"rendered":"Pay Fixation"},"content":{"rendered":"\t\t<div data-elementor-type=\"wp-page\" data-elementor-id=\"1426\" class=\"elementor elementor-1426\">\n\t\t\t\t<div class=\"elementor-element elementor-element-f97c5ab e-flex e-con-boxed e-con e-parent\" data-id=\"f97c5ab\" data-element_type=\"container\" data-e-type=\"container\">\n\t\t\t\t\t<div class=\"e-con-inner\">\n\t\t\t\t<div class=\"elementor-element elementor-element-e8831ec elementor-widget elementor-widget-text-editor\" data-id=\"e8831ec\" data-element_type=\"widget\" data-e-type=\"widget\" data-widget_type=\"text-editor.default\">\n\t\t\t\t<div class=\"elementor-widget-container\">\n\t\t\t\t\t\t\t\t\t<h5><u><br \/>Pay Fixation<br \/><br \/><\/u><\/h5><h5><u>Rule 4.1(1)<\/u><br \/><br \/><\/h5><h5>\u00a7\u00a0 \u00a0 A competent authority may fix the pay of a Government employee, but his <em>pay shall not be so increased as to exceed the pay sanctioned<\/em> for his post without the sanction of the authority \u2018competent\u2019 to create a post in the same cadre on a rate of pay equal to his pay so increased.<\/h5><h5>\u00a0<\/h5><h5>Fixed Monthly Emoluments:<\/h5><h5>\u00a7\u00a0 Means the amount drawn monthly by a GE equal to the minimum of the pay band of the service or post to which he is appointed and shall not include grade pay, special pay, annual increment or any other allowance, except travelling allowance drawn with reference to the grade pay of the relevant service or post.<\/h5><h5>\u00a7\u00a0 Provided that when the service of a GE, who was receiving fixed monthly emoluments during the period of probation are confirmed, the period spent on probation by him, shall not be treated to be the time spent on the time scale applicable to his post.<\/h5><h5>\u00a0<\/h5><h5><strong>Fixation of Initial Pay<br \/><\/strong>\u00a0Rule 4.4:<\/h5><h5>\u00a7 \u00a0\u00a0 The initial substantive pay of a Government employee who is appointed substantively to a post on a time scale or pay is regulated as follows:<\/h5><h5>4.4.(a)(i)<\/h5><h5>\u00a7\u00a0 When appointment to the new post involves the assumption of duties or responsibilities of greater importance ( as interpreted for the purpose of rule 4.13 ) than these attaching to such permanent post, he will draw as initial pay, the stage of the time scale next above his substantive pay in respect of the old post.<\/h5><h5>\u00a0<\/h5><h5>4.4(a)ii<\/h5><h5>\u00a7\u00a0\u00a0 When appointment to the new post does not involve such assumption, he will draw as initial pay the stage of the time scale which is equal to his substantive pay in respect of the old post, or\u00a0 if there is not such stage, the stage next below that pay plus personal pay equal to the difference; and in either case will continue to draw that pay until such time as he would have received an increment in the time scale of the old post or for the period after which an increment is earned in the time scale of the new post, whichever is less.\u00a0\u00a0 But if the minimum of the time scale of the new post is higher than his substantive pay in respect of the old post he will draw that minimum as initial pay.<\/h5><h5>\u00a0<\/h5><h5>4.4.(a)iii<\/h5><h5>\u00a7\u00a0 When appointment to the new post is made on his own request under rule 3.17 (a) and maximum pay in the time scale of that post is less than his substantive pay in respect of the old post, he will draw that maximum as initial pay.<\/h5><h5>\u00a0<\/h5><h5>4.4-A (i)<\/h5><h5>\u00a7\u00a0 When appointment to the new post involves the assumption of duties or responsibilities of greater importance than these attaching to the old post on which he holds a lien, his initial pay shall be fixed by granting him the benefit of one increment and the grade pay of the new post.<\/h5><h5>4.4-A (ii)<\/h5><h5>\u00a7\u00a0 When appointment to the new post does not involve duties and responsibilities of greater importance, he shall draw as initial pay, which is equal to the substantive pay in respect of the old post. However, the higher grade pay, if any admissible under this clause shall be absorbed at the time of grant of benefit of fixation of pay under an ACP scheme.<\/h5><h5>4.4-A- (iii)<\/h5><h5>\u00a7\u00a0 When a GE is appointed to a post carrying lower grade pay on his own request under rule 3.17(a), his initial pay shall be fixed equal to the pay in pay band drawn by him in the old post plus the grade pay of the new post. However, if the maximum of the pay band in the time scale of lower post is less than his substantive pay in respect of the old post, his initial pay shall be fixed equal to the maximum of the pay band plus the grade pay of the new post.<\/h5><h5>Fixation of pay on promotion after 01.01.2006<\/h5><h5>\u00a7\u00a0 The pay of the GE, who are promoted in the higher grade, shall continue to be regulated in accordance with the provisions of rule 11 of the Punjab Civil Services (Revised pay) Rules, 2009<\/h5><h5>Pay on Promotion :\u00a0 Rule 11<\/h5><h5>\u00a7\u00a0 In the revised pay structure, on promotion the pay fixation will be done as follows:-<\/h5><h5>\u00a0<\/h5><h5>i)\u00a0\u00a0\u00a0 One increment equal to three percent of the sum of the pay in the pay band and the existing grade pay will be computed and rounded off to the next multiple of 10.\u00a0 This will be added to the existing pay in the pay band.\u00a0 The grade pay corresponding to the promotion post will thereafter be granted in addition to this pay in the pay band.\u00a0 In cases where promotion involves change in the pay band also, the same methodology will be followed.\u00a0 However, if the pay in the band after adding the increment is less than the minimum of the higher pay band to which promotion is being made, the pay in the pay band will be stepped to such minimum.<\/h5><h5>\u00a0<\/h5><h5>Pay on Promotion :\u00a0 Rule 11<\/h5><h5>On promotion from one grade pay to another, an employee shall have an option to get his pay fixed in the higher post either from the date of his promotion or from the date of his next increment. The option may be exercised within one month from the date of promotion.<\/h5><h5>The option once exercised, shall be final.<\/h5><h5>\u00a0<\/h5><h5>Pay on Promotion :\u00a0 Rule 11<\/h5><h5>iii)\u00a0 In case, the Government employee opts to get his pay fixed in the higher post from the date of his promotion, the next increment in the higher post will be granted after completion of qualifying service of twelve months.<\/h5><h5>\u00a0<\/h5><h5>Pay on Promotion :\u00a0 Rule 11<\/h5><h5>In case, the Government employee opts to get his pay fixed from the date of his next increment, then on the date of promotion, pay in the pay band shall not be changed, but the grade pay of the higher post will be granted.\u00a0 Further re-fixation will be done on the date of his next increment.\u00a0 On that date he will get two increments; one annual increment and the second on account of promotion.<\/h5><h5>While computing these two increments basic pay prior to the date of promotion shall be taken into account.\u00a0 To illustrate, if the basic pay prior to the date of promotion was 100, first increment would be computed on Rs. 100 and the second increment on Rs. 103.<\/h5><h5>The next increment in the higher post in this case will be granted after completion of qualifying service of twelve months from the date of re-fixation.<\/h5><h5>\u00a0<\/h5><h5>Pay on Promotion :\u00a0 Rule 11<\/h5><h5>\u00a7\u00a0 Note 1.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 A Government employee drawing pay in the higher pay scale\/grade pay on account of progression under ACP scheme on promotion, will be given the benefit of one increment and such higher pay scale\/grade pay shall be protected as a measure, personal to him.<\/h5><h5>\u00a7\u00a0 Note 2.\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0\u00a0 For the purpose of promotion, the grade pay of Rs. 5400 in PB-4 shall be treated as higher than the grade pay of Rs. 5400 in PB-3.<strong>]<\/strong><\/h5><h5>Rule 4.7 (Increments)<\/h5><h5>\u00a7\u00a0 <strong>4.7<\/strong>. An increment shall ordinarily be drawn as a matter of course, unless it is withheld. An increment may be withheld from a Government employee by a competent authority if his conduct has not been good or his work has not been satisfactory. In ordering the withholding of an increment, the withholding authority shall state the period for which it is withheld, and whether the postponement shall have the effect of postponing future increments.<\/h5><h5>Rule 4.9<\/h5><h5>\u00a7 <strong>4.9.<\/strong> The following provisions prescribe the conditions on which service counts for increments in a time-scale:-<\/h5><h5>Rule 4.9(a)<\/h5><h5>\u00a7\u00a0 <strong>(a)<\/strong> All duty in a post on a time-scale counts for increment in that time-scale; provided that, for the purpose of arriving at the date of the next increment in that time-scale, the total of all such periods as do not count for increment in that time-scale shall be added to the normal date of increment.<\/h5><h5>\u00a0<\/h5><h5>Rule 4.9(A)<\/h5><h5>\u00a7\u00a0 <strong>4.9-A.<\/strong> Notwithstanding anything contained in the foregoing rule, the annual increments shall be allowed with effect from the first day of the month in which they fall due under the normal rules regulating increments.<\/h5><h5>Rule 4.9(A)<\/h5><h5>\u00a7\u00a0 <strong>Note 1.-<\/strong> The increment of an employee on leave due on the first day of the month will be drawn from the date of resuming his duty on return from leave, because during leave the employee gets leave salary only.<\/h5><h5>Rule 4.9(A)<\/h5><h5>\u00a7\u00a0 <strong>Note 5.-<\/strong>Where the normal increment is withheld for specific period and the period of such penalty expires after first day of the month, increment will be granted or restored from the date of the penalty ceases.<\/h5><h5>\u00a0<\/h5><h5>Rule 4.10<\/h5><h5>\u00a7\u00a0 <strong>4.10.<\/strong> Subject to any general or special orders that may be made by the competent authority in this behalf, an authority may grant a premature increment.<\/h5><h5>Rule 4.11<\/h5><h5>\u00a7\u00a0 <strong>4.11.<\/strong> The authority which orders the transfer of a Government employee as a penalty from a higher to a lower grade or post may allow him to draw any pay, not exceeding the maximum of the lower grade or post, which it may think proper:<\/h5><h5>\u00a7\u00a0 Provided that the pay allowed to be drawn by a Government employee under this rule shall not exceed the pay which he would have drawn by the operation of rule 4.5 read with clause (b) or clause (c), as the case may be, of rule 4.9.<\/h5><h5>Rule 4.12(1)<\/h5><h5>\u00a7\u00a0 <strong>4.12. (1)<\/strong> If a Government employee is reduced as a measure of penalty to a lower stage in his time-scale, the authority ordering such reduction shall state the period for which it shall be effective and whether, on restoration the period of reduction shall operate to postpone future increments and, if so, to what extent.<\/h5><h5>\u00a7\u00a0 postpone future increments.<\/h5><h5>Rule 4.14(2)<\/h5><h5>\u00a7\u00a0 <strong>(2)<\/strong> On an enhancement in the substantive pay, as a result of increment or otherwise, the pay of such Government employee shall be re-fixed under sub-rule (1) from the date of such enhancement as if he was appointed to officiate in that post on that date where such re-fixation is to his advantage.<\/h5><h5>\u00a7\u00a0 <strong>Note 1.-<\/strong> See also Notes 7 and 8 below rule 4.13.<\/h5><h5>Rule 4.24<\/h5><h5>\u00a7 <strong>4.24.<\/strong> When a Government employee holds current duty charge of another post in addition to that of his own substantive post he does not officiate in the former post and as such is not entitled to any additional remuneration.<\/h5><h5><br \/><br \/><\/h5>\t\t\t\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t\t\t<\/div>\n\t\t","protected":false},"excerpt":{"rendered":"<p>Pay Fixation Rule 4.1(1) \u00a7\u00a0 \u00a0 A competent authority may fix the pay of a Government employee, but his pay shall not be so increased as to exceed the pay sanctioned for his post without the sanction of the authority \u2018competent\u2019 to create a post in the same cadre on a rate of pay equal [&hellip;]<\/p>\n","protected":false},"author":1,"featured_media":0,"parent":0,"menu_order":0,"comment_status":"closed","ping_status":"closed","template":"","meta":{"footnotes":""},"class_list":["post-1426","page","type-page","status-publish","hentry"],"_links":{"self":[{"href":"https:\/\/punjabcsr.com\/index.php\/wp-json\/wp\/v2\/pages\/1426","targetHints":{"allow":["GET"]}}],"collection":[{"href":"https:\/\/punjabcsr.com\/index.php\/wp-json\/wp\/v2\/pages"}],"about":[{"href":"https:\/\/punjabcsr.com\/index.php\/wp-json\/wp\/v2\/types\/page"}],"author":[{"embeddable":true,"href":"https:\/\/punjabcsr.com\/index.php\/wp-json\/wp\/v2\/users\/1"}],"replies":[{"embeddable":true,"href":"https:\/\/punjabcsr.com\/index.php\/wp-json\/wp\/v2\/comments?post=1426"}],"version-history":[{"count":4,"href":"https:\/\/punjabcsr.com\/index.php\/wp-json\/wp\/v2\/pages\/1426\/revisions"}],"predecessor-version":[{"id":2558,"href":"https:\/\/punjabcsr.com\/index.php\/wp-json\/wp\/v2\/pages\/1426\/revisions\/2558"}],"wp:attachment":[{"href":"https:\/\/punjabcsr.com\/index.php\/wp-json\/wp\/v2\/media?parent=1426"}],"curies":[{"name":"wp","href":"https:\/\/api.w.org\/{rel}","templated":true}]}}
